Welcome to laineswanson.com. The laineswanson.com website (the “Site”) is comprised of various web pages operated by Laine Swanson. Laineswanson.com is offered to you conditioned on your acceptance without modifications of the terms, conditions, and notices contained herein (the “Terms”). Your use of laineswanson.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

laineswanson.com is a Fine Art Website showcasing the original paintings and drawings of Laine Swanson, with both originals and prints for sale.

Your use of laineswanson.com is subject to Laine Swanson’s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications
Visiting laineswanson.com or sending emails to Laine Swanson constitutes electronic communication. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirements that such communications be in writing.

Children Under Thirteen
Laine Swanson does not knowingly collect, either online or off-line, personal information from persons under the age of thirteen. If you are under 18, you may use laineswanson.com only with permission of a parent or guardian.

Cancellation/Refund Policy
Please contact Laine Swanson via email to initiate an exchange or return: laineswansonart@gmail.com within 14 days after delivery. If 14 days has passed and you have not contacted us, we can no longer offer a refund or exchange. Please use original packaging to ship the item(s) back to seller within 30 days. Packaging must be postmarked, and the item(s) must be in the same condition you received them.
**Receipt required of proof of purchase in order to complete your return.
Refunds
As applicable, once your return is received and shown to be in original packaging, and original, good condition, we will send you an email to notify you that we have received your returned item. This email will notify you if the return for a refund has been approved or rejected. Upon approval, your refund will be processed and applied to your form of original method of payment.
Late or missing refunds
As applicable, if you have not received your refund, please check your account/original method of payment again. Then contact your credit card or bank company, as refunds can take time to process and post to the account. If you have done all of this and still do not have your refund, please contact us again at laineswansonart@gmail.com.
Exchanges
As applicable, we only replace items if they are defective or damaged. If that is the case, and an exchange for the same item is needed, please email us at laineswansonart@gmail.com, and send the original item back in the original packaging.
Buyer is responsible for paying shipping costs for returning an item. Shipping costs are non-refundable.
Time to process a refund or exchange may vary depending on where you live, and where the product was shipped to.
If you are shipping over $50 worth of items, consider tracking the shipment or purchasing shipping insurance. We cannot guarantee that we will receive your returned item(s).

Termination/Access Restriction
Laine Swanson reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Minnesota and you hereby consent to the exclusive jurisdiction and venue of courts in Minnesota in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Laine Swanson as a result of this agreement of us of the Site. Laine Swanson’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Laine Swanson’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided or gathered by Laine Swanson with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Laine Swanson with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Laine Swanson with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Laine Swanson reserves the right, in its sole discretion, to change the Terms under with laineswanson.com is offered. The most current version of the Terms will supersede all versions. Laine Swanson encourages you to periodically review the Terms to stay informed of our updates.
